Suspect in Nathaniel Julies murder case to apply for bail

One of the three police officers accused of the murder of Nathaniel Julies is expected to make another attempt to apply for bail in the Protea Magistrate’s Court in Soweto on Thursday.

Simon ‘Scorpion’ Ndyalvane, Caitlin Whiteboy, and Foster Netshiongolo, are accused of killing Julies near his home in Eldorado park, south of Johannesburg last month.

Julies, who had Down Syndrome, was shot and later died in hospital.

The murder of caused an uproar in Eldorado Park leading to protests.

Last month, Magistrate David Mhango denied bail to all three accused saying they had not presented any exceptional circumstances to warrant that they be released on bail.

He said there was also a likelihood that it would disturb the peace in the community.

However, one of the accused Netshiongolo is expected to bring an application for bail based on new facts.

Ndyalvane and Whiteboy face charges of murder, discharging of a firearm in a public place, being in possession of prohibited ammunition and defeating the ends of justice.

W Cape police commissioner meets MEC over Cape Flats gun violence

The Western Cape government says it is satisfied with efforts by police to clamp down on the spate of violent crimes which have rocked various parts of the Cape Flats in recent weeks.

Areas such as Hanover Park, Joe Slovo and Khayelitsha have seen a spike in shooting incidents and mass killings.

Western Cape Minister of Community Safety Albert Fritz met with provincial police commissioner Yolisa Matakata to discuss interventions which have been put in place to arrest the violence.

Communities like Ravensmead, Khayelitsha, Nyanga, Joe Slovo and Hanover Park have been living on tenterhooks in recent weeks as flare ups in shooting incidents have claimed as many as 20 lives.

The mass shooting of people within their homes has been highlighted as of particular concern, with Fritz saying the crimes relate to a number of issues including extortion and territorial gang violence.

Fritz says, “They have very detailed, individual investigations of all the cases and in many instances it’s murders, remember its in house in the home, by these young gang elements and takes different shapes, you know how different the gangs are in certain areas, its different to other areas…”

“But it all looks like extortion stuff, territorial stuff and it’s unfortunately creeping into our black communities now. That’s a worrying sign,” added Fritz.

He says he is happy with the police’s strategy at station level especially in Hanover Park and also at provincial level. He says the province is also looking at ways to develop legislation around tracking and tracing ammunition sold in the province.

“We just saw the violence subsiding over the weekend, we didn’t have any incidents of heavy violence partly because of the action and swift action of SAPS but also because of the support that we now as leap officers are giving as force multipliers so we are very happy and encouraged,” says Fritz.

Residents of Hanover Park urged to help bring change to the violence-wrecked area

Law enforcement officers are already on the ground in Hanover Park to assist police in crime prevention. More officers will also be deployed to other hotspots including Delft, Nyanga and Khayelitsha.

Western Cape Premier Alan Winde took part in a safety patrol in Delft as part of a long term violence prevention plan.

Winde says, “We got to walk with the partnership between our neighbourhood watches and the deployment of law enforcement officers to our crime hot spots along with police services. It is critical that we build these partnerships in our communities so that we start to make our communities safer. This is part of the safety plan of boots on the ground on the one side and then getting behavioural change and making sure violent prevention in the long term becomes a focus.”

Investigations meanwhile continue into mass shooting incidents in Khayelistha, where six people were killed at a house in Site C.

There have also been no arrests as yet in connection with the mass shooting of five people in two separate incidents, allegedly by the same suspects in Joe Slovo in Milnerton.

President Ramaphosa to address Parliament joint sitting

President Cyril Ramaphosa will on Thursday unveil government’s economic reconstruction and recovery plan during a joint sitting of Parliament.

In a letter he wrote to National Assembly Speaker Thandi Modise last week requesting the joint sitting, the President said the country needs to take extraordinary measures towards a speedy and sustainable economic recovery.

The COVID-19 pandemic has had a devastating impact on the economy due to lockdown where some of the economic activities came to a standstill except essential services.

The video below looks at expectations from President Ramaphosa’s economic recovery plan:

The joint sitting which will be hold via hybrid will be at 2 pm in the afternoon.

The economic recovery plan seeks to address the huge economic fallout and job losses that have resulted from the COVID-19 lockdown.

The joint sitting means the President’s reply to oral questions in the National Council of Provinces (NCOP) will be rescheduled.

State capture perpetrators should be held accountable: NPA

Angelo Agrizzi at the commission of enquiry

The National Prosecuting Authority (NPA) says it is important that those accused of state capture should be held to account for their actions.

The Investigating Directorate in the NPA was responding after former Bosasa Chief Operating Officer (COO) Angelo Agrizzi was denied bail by the Commercial Crimes court sitting at the Palm Ridge Magistrates’ Court, in Johannesburg yesterday.

Agrizzi blew the whistle last year at the State Capture Commission on the alleged dodgy BOSASA dealings with politicians to get government tenders, mostly in the Correctional Services Department.

Agrizzi has spent his first night in jail after being denied bail.

The Investigating Directorate’s spokesperson, Sindisiwe Twala says they’ve been working around the clock to bring the culprits in the state capture debacle to book.

“What we can deduce from investigations between the investigative directive lead by advocate Herman and alongside various other law enforcement agents, we were able to see that there is some form of a plan to leave the country and evade any form of prosecution.”

“So after he gave his evidence at the state capture commission, we got on top of this case to find out what exactly is happening behind the scenes. We were then able to uncover that he has over R35 million. We discovered [that the] money was siphoned out of the country. We are reclaiming the country from capture,” explains Twala.

Court to hear Omotoso’s third bail application

The third bail application of Pastor Timothy Omotoso is expected to continue at the Port Elizabeth High Court on Thursday.

Details around the dramatic arrest of Omotoso at the Port Elizabeth airport in 2017, were argued in court on Wednesday, where his defence advocate, Terry Price told the court that Omotoso came to Port Elizabeth voluntarily to be interviewed by his legal team and the Hawks, only to be arrested.

Omotoso and his two co-accused Zukiswa Sitho and Lusanda Solani face several sex related charges involving young women from his Jesus Dominion International Church.

Department of Home Affairs officials have confirmed that Omotoso is still a prohibited person in the country and was declared prohibited after his arrest, but this was uplifted by the High Court after Omotoso appealed against it in 2019.

Meanwhile, the Department of Home Affairs declared him a prohibited person again three weeks ago, as he has no legal documents or permits and could be deported should he get bail.

Omotoso’s lawyer, Price says the court can issue an order with strict restrictions which could include an amount to be paid, house arrest, and that he reports to court for the trial.

Timothy Omotoso’s bail application continues

Investigating officer of the Hawks, warrant officer Peter Plaatjies said since Omotoso’s arrest in April 2017, they could not get hold of his two passports. They are in the possession of his attorney, and they were only given copies thereof.

Defence advocate Price argued that an illegal foreigner may be granted bail, with strict conditions and then the Dept of Home Affairs would have no say.

Meanwhile, the threatening messages received by some victims must still be translated from various African languages.
